Reporting and assessing unlawful content

Introduction

Homio aims to make reliable, high-quality and lawful property listings available. If you believe a listing or other published content on Homio is unlawful or contains untrue information, you can report it easily and electronically.

What to include in your report

  • the exact URL or identifier of the listing concerned (send it to info@homio.hu, or click the “Report listing” button below the listing);
  • a detailed explanation of why you consider the content unlawful;
  • any further information or evidence needed;
  • your name and email address;
  • a statement that you are acting in good faith and that the information and claims in your report are, to the best of your knowledge, accurate and complete.

Reporting without an account

You do not need a Homio account to report. If you give your email address, we will confirm that your report has arrived and tell you about the decision made on it.

How we assess reports

We examine every report on the basis of the information available to us, with due care, objectively and not arbitrarily. A report does not automatically mean a listing is removed: we examine whether there is unlawfulness or a breach of Homio's policies.

In assessing a report we look in particular at

  • which exact listing and which content it concerns;
  • what unlawfulness or breach of policy the reporter alleges;
  • whether the infringement can be established from the information available;
  • whether the listing contains misleading, false or materially incomplete information;
  • whether copyright, personality rights or data protection rights are affected;
  • whether fraud, spam, abuse or a security risk arises;
  • whether further information needs to be requested;
  • whether the planned measure is proportionate.

What decisions we may take

  • we take no action if no unlawfulness or breach of policy can be established from the report;
  • we ask the advertiser for a correction if the problem can be corrected;
  • we restrict certain elements or the visibility of the listing, where the applicable rules allow it;
  • we remove the listing or make it inaccessible if we find unlawful content or a serious breach of policy;
  • in case of repeated or serious abuse, we may restrict the related user or partner access.

How we give reasons for our decisions

If we apply a restrictive measure to a listing, we inform the advertiser concerned at the electronic contact details available to us. The notice states the type of measure and the essential facts and circumstances on which the decision is based.

If the decision is based on unlawful content or a breach of Homio's terms and conditions, we state the relevant legal or contractual basis and explain in plain language why the measure was taken. If an automated means was used in reaching the decision, we say so.

Our principles

  • Not every report is well founded, so we examine the report and the content concerned separately.
  • Decisions are not made solely on the reporter's claim.
  • In moderation we take into account the relevant facts and the applicable law.
  • Homio's moderation is not a judicial or official legal decision.

Serious safety incidents

If Homio becomes aware of information giving rise to a suspicion of a criminal offence threatening a person's life or safety, we promptly make the necessary report to the authorities, in accordance with the applicable law.

Records and retention

Homio keeps a record of reported cases and retains it for 24 months.
